STANDARD TERMS AND CONDITIONS FOR SALE OF GOODS OF ENOSI LIMITED
1 DEFINITIONS
In this document the following words shall have the following meanings:
1.1 "Buyer" means the person who buys Goods from the Seller;
1.2 "Consumer" shall have the meaning ascribed in section 12 of the Unfair Contract Terms Act 1977;
1.3 "Goods" means the articles that the Buyer agrees to buy from the Seller;
1.4 "List Price" means the list of prices of the Goods maintained by the Seller as amended from time to time;
1.4 "Seller" means ENOSI LIMITED of 62 Southgate Road, Potters Bar, Herts., EN6 5DZ
1.5 "Terms and Conditions" means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the Seller.
2 GENERAL
2.1 These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer.
2.2 Whilst every effort has been made to display the colours of our products as accurately as possible on this website, the actual colours you see will depend on your own monitor. We can not guarantee that the colour displayed on your monitor will accurately reflect the colour of the product on delivery. Seller takes all reasonable care to ensure that all details, descriptions and prices of products appearing on our website are correct at the time the information is entered onto the system. We reserve the right to refuse orders where product information has been entered onto our website incorrectly including prices and promotional activity. Prices are subject to change without notice. All goods offered on the Seller website are subject to availability. If an item you have ordered is out of stock before your order is accepted, we will notify you as soon as possible.
2.3 All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions and are subject to acceptance by the Seller. The Seller may choose not to accept an order for any reason.
2.4 Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyer's acceptance of these Terms and Conditions.
2.5 Any variation to these Terms and Conditions shall be inapplicable unless agreed in writing by the Seller.
2.6 Nothing in these Terms and Conditions shall affect the Buyer's statutory rights as a Consumer.
3 PRICE AND PAYMENT
3.1 The price of the Goods shall be that stipulated in the Seller's current online list price at the date of order or as agreed between the parties. The price is exclusive of VAT and any delivery charges.
3.2 Payment of the total purchase price (including VAT and any delivery charges) must be made in full before dispatch of the Goods.
4 DELIVERY
4.1 Our Standard Delivery service will deliver orders within 2-3 working days (Monday – Friday), subject to product availability and credit check clearance. Please see table below for current charges:

NB: In some remote regions Economy Delivery may take up to 7 days, and Next Day Delivery may take 2 days
4.2 Delivery of the Goods shall be made by the Seller to such place and on such terms as agreed between the Seller and the Buyer at the time the order is placed. A signature is required upon delivery as proof of the Buyer receiving the Goods from the Seller. Please note that we are unable to deliver to PO Boxes.
4.3 All Goods, wherever possible, will be delivered within 3 working days of the order being placed and the Buyer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.
4.4 The Seller shall use its reasonable endeavours to meet any date stated for delivery. In any event time of delivery shall not be of the essence and the Seller shall not be liable for any losses, costs, damages or expenses incurred by the Buyer or any third party arising directly or indirectly out of any failure to meet any estimated delivery date.
4.5 In the event that the Buyer is unable to take delivery of the Goods at the specified time, the Buyer will deal directly with our courier to arrange a second delivery, at no extra charge.
4.6 Some Goods may not be in stock at the time the order is placed. In the event that the Seller is unable to deliver the Goods within the time specified in Clause 4.3, the Seller will contact the Buyer to advise of the situation and the Buyer shall be entitled to cancel the order and receive a full refund or agree a later delivery date.
4.7 Title and risk in the Goods shall pass to the Buyer upon delivery of the Goods.
5 WARRANTY
The Seller warrants that the Goods will at the time of delivery correspond to the description given by the Seller.
6 CANCELLATION AND RETURNS
We hope you will be highly satisfied with any product purchased on our website but if you wish to return an item to us then we aim to make it as quick and convenient as possible.
6.1 If you wish to cancel any order you may do so at anytime after an order has been placed or up to 7 days after the date of delivery. All notices of cancellation must be given to the Seller in writing by using the Returns Request Process (as detailed below). The goods must then be returned at your own expense to the Seller within 14 days of acceptance, by the Seller, of your returns request. If you are unable to return the goods you must make the goods available for collection upon request and within 14 days of acceptance, by the Seller, of your returns request. This will be at your expense and you will not be entitled to a refund of the original delivery charge. The Seller will be entitled to charge you (an equivalent amount to the original delivery charge) for this collection. These conditions will still apply in the event of any discount/special offer applied to delivery charges.
The Seller will not be liable for any costs incurred in the return of cancelled orders. The goods will not be deemed to have been returned until notification is given by the Seller that the goods have been returned to the address advised by the Seller.
6.2 It is your responsibility to return all goods in the same condition as they were upon delivery. The Seller reserves the right to deduct from the refund any charges necessary for the repair or cleaning of any goods returned not in the same condition as upon delivery. You are advised to retain the original packaging in the event of you cancelling an order. The Seller retains the right to charge for any necessary packaging/re-packaging.
The Seller shall be entitled to recover all costs, losses, charges, and expenses incurred in connection with goods returned not saleable as new.
Additionally there will be a re-stocking charge (an equivalent amount to the original delivery charge) to cover the original cost of shipping to you to be deducted from any refund applicable.
6.3 Where a product is proven to be faulty or the wrong item has been delivered, the Buyer is entitled to either a full refund or replacement product.
In the event of a refund we will not charge a handling fee and provided the item is returned within a 28 day period we will refund the cost of all delivery charges upon proof of payment.
In the event of a replacement product being shipped, the Buyer shall be entitled to a refund of any return delivery charges upon proof of payment.
6.4 It is recommended that packages are returned using a traceable, insured form of delivery that requires a signature upon delivery such as Royal Mail Special or Recorded delivery; please enclose proof of postage receipt for a refund to be processed if applicable.
RETURNS REQUEST PROCESS
It's easy to request to return an item, click on the link below to email us stating your order number, item code(s), and reason(s) for wishing to return each item.
The Return Requests are then checked by our Customer Services Team, who will contact you via email confirming that the request has been accepted, issue you with a Return Material Authorisation (RMA) number, and instructions on how to return the item to us. They may also reject any return request, and if they do so will explain the reason(s) why via email.
The RMA number provided must be clearly stated on the outside of all packages returned, failure to do so may result in a delay of up to 30 days in processing your return.
7 LIMITATION OF LIABILITY
7.1 Nothing in these Terms and Conditions shall exclude or limit the liability of the Seller for death or personal injury, however the Seller shall not be liable for any direct loss or damage suffered by the Buyer howsoever caused, as a result of any negligence, breach of contract or otherwise in excess of the price of the Goods.
7.2 The Seller shall not be liable under any circumstances to the Buyer or any third party for any indirect or consequential loss of profit, consequential or other economic loss suffered by the Buyer howsoever caused, as a result of any negligence, breach of contract, misrepresentation or otherwise.
8 GRIEVANCE PROCEDURE
In the unlikely event that you should have any grievance with the service / products offered by the Seller, you are advised to contact the Seller via email at: info@homeofficesecurity.co.uk clearly stating your order number, the nature of your complaint and your contact details, to enable us to resolve the issue in the shortest time possible.
9 FORCE MAJEURE
Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the party shall be entitled to a reasonable extension of its obligations.
10 SEVERANCE
If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid, illegal or unenforceable provision eliminated.
11 GOVERNING LAW AND JURISDICTION
These Terms and Conditions shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.
12 PRIVACY
Seller is committed to ensuring the privacy of its customers. As such, we explain why we ask for certain information, and reassure our customers that any information received will be used in the strictest confidence. The most recent policy can be found on this website, and any updates will immediately appear here.
Whenever an order is placed, we typically require a name, home address, telephone number and email address. This is to allow us to keep many communication channels available should the need to contact you arise, and also so we know where to send your delivery.
In order for you to purchase products from this site, we are required to take payment details and the address the card / account is registered at. This is to allow verification of card details to be carried out and prevent abuse of our system. This information will not be passed on to any other organisations or websites, other than those who handle our payments.
In the future we will aim to continue our relationship with our customers by keeping them up to date with the latest products and promotions we are offering. This will involve an email being sent to the address provided. If you do not wish to receive these emails, the option is readily available for you to unsubscribe.
From time to time we may also wish to ask your valued opinion of the site as a means of trying to enhance the service we offer to our customers. This will usually involve an email questionnaire sent to the email address you have provided to the site.
